On the morning of the 27th, the subcommittee of the Legislation and Judiciary Committee passed a so-called `Save the Law' (Amendment to the Civil Law) that prohibits parents from having an inheritance right. The bill is expected to be approved at the plenary session on the 28th after a plenary session of the Judiciary Committee later in the day.
The Guhara Act calls for serious violations of ▶ the obligation to support minors or serious criminal acts or gross unfair treatment to the heir or their spouse or heir's immediate descendants to be grounds for the loss of inheritance rights.
When Gu Ha-ra died in 2019, his birth mother, who ran away from home and did not fulfill her parenting obligations, demanded half of the inherited property, and his brother Koo Ki-in filed a legislative petition saying, `A mother who left Gu Ha-ra young and ran away is about to receive half of the inherited property after Gu Ha-ra's death.'
The Guhara Act, which was also proposed in the 20th National Assembly, was not properly discussed and was abolished at the end of the term. In April, the Constitutional Court ruled that the legal reserve of inheritance system, which forces siblings to inherit more than a certain percentage of inheritance regardless of the deceased's intention, was unconstitutional, and the Save the Law was also accelerated.
