An attorney for YouTuber A (35, female), who was indicted on charges of defamation and insults under the Act on Promotion of Information and Communication Network Utilization and Information Protection, said in the first trial held at the Incheon District Court's Criminal Chamber 11 on the 2nd, `We acknowledge the fact that the video was produced, but deny the rest of the charges.'
He then argued that "even if it was not intentional in relation to defamation or obstruction of business, it would be considered true, so it would be illegal."
When Judge Kim asked, "(The video) is an opinion and it says it is not defamatory, but is it intentional?" A's lawyer replied, "(The purpose is that it is difficult to see it as defamation because it is only an opinion."
It was also revealed during the trial that A was being investigated by the Incheon District Prosecutors' Office on additional charges.
Mr. A's lawyer said "The defendant is still pending in two other cases at the Incheon District Prosecutors' Office and is expected to be prosecuted soon."The two cases are similar to the previous ones, but the victims are different and charged with defamation and insults" he explained.
A attended the court with minimal face exposure by wearing black top and bottom and glasses and a mask. In addition, he answered Judge Kang's acknowledgment newspaper, which checks the date of birth and residence, with a calm voice. The occupation is 'businessman' he said.
A's next trial will be held at the Incheon District Court at 10 a.m. on October 2.
Earlier, A is accused of defaming seven celebrities, including celebrities and influencer, by posting videos 23 times on his YouTube channel 'Taldeok Detention Center' that he operated from October 2021 to June last year. 'Taldeok concentration camp' is a YouTube channel that produces videos based on malicious rumors of idols and has been deleted.
He is also accused of posting videos disparaging the appearance of five of the victims on YouTube channels 19 times.
Mr. A was found to have produced and distributed false videos, saying, `Jang Won-young's jealousy prevented fellow trainees from making their debuts,' or `Other celebrities also engaged in prostitution or plastic surgery.'
As a result of the prosecution's analysis of YouTube channel accounts, it was found that A earned 250 million won in profits for two years from June 2021. It was also revealed that A purchased real estate with part of the YouTube channel's profits.
Starship Entertainment filed a lawsuit against A for damages, saying Jang Won-young was defamed by the continuous spread of false information, and was ruled in favor of the plaintiff in January. The court ordered that `pay KRW 100 million to Jang Won-young.' The second trial is currently underway.
