Choi Min-hwan Under Investigation Serious Penalties Possible for Sexual Violence Charges

Police have launched an investigation into Choi Min-hwan of FTIsland, who is suspected of prostitution and sexual harassment. The Gangnam Police Station in Seoul announced on the 31st that they have assigned three investigative teams to look into Choi Min-hwan's alleged violations of the Sex Trafficking and Sexual Violence Punishment Act and the Sexual Violence Punishment Act.

The police plan to call the accuser for questioning soon, but it has not yet been decided whether Choi Min-hwan will be summoned. When asked about his recall and any potential charges, the police stated, "It is difficult to discuss a case where the investigation has just begun."

What are the potential consequences if Choi Min-hwan is found guilty? On YTN Radio's "Wise Radio Life," which aired on the 30th, lawyer Ko-eun, who specializes in sex crimes, shared her thoughts on the transcript of Choi Min-hwan's alleged prostitution.

The lawyer remarked, "It's shocking in many ways. While hiring hospitality workers in entertainment establishments is legal, there must be sexual intercourse for it to be considered prostitution. This usually happens in accommodations after visiting bars."

Ko-eun explained that the amounts sent via Telegram exceed typical rates, raising questions about whether these costs are merely for hospitality services. She noted that proving sexual transactions based solely on recordings can be challenging, which casts doubt on the prostitution allegations.

Another lawyer, Lee, stated, "Choi Min-hwan seems very familiar with this entertainment culture." He emphasized that a lack of experience in navigating this environment would make it difficult for someone to engage naturally in these transactions. If evidence reveals multiple instances of sexual purchase, it would likely hinder his chances of receiving a suspension of prosecution, resulting in a higher likelihood of fines or more severe penalties.

Regarding punishment, if convicted of sex purchase, the penalties are relatively lenient—up to one year in prison, fines of up to 3 million won, or detention. First-time offenders often receive suspensions of prosecution, but repeat offenses typically lead to heavier fines.

Moreover, if a divorce lawsuit is filed, it could be considered a breach of the couple's duty of conciliation, which may have negative consequences.

Choi Min-hwan's behavior, as revealed by his ex-wife Yul-hee, suggests that even within relationships, acts of rape or forced harassment can be established. On the 24th, Yul-hee disclosed incidents of sexual harassment on her YouTube channel, "Yul-hee's House," and shared a recording of a call suggesting involvement in a prostitution business.

Following the allegations, Choi Min-hwan was accused of violating the Special Act on Prostitution. As the controversy intensified, he withdrew from programs such as KBS 2TV's "Superman is Back," and broadcasters began erasing his appearances by making related videos private.

Lee Hong-gi, a member of FT Island, defended Choi Min-hwan, questioning, "Can you be held responsible if it's not sex trafficking?" However, due to the backlash, his agency, FNC Entertainment, announced a temporary two-member system for the group, continuing with Lee Hong-ki and Lee Jae-jin.

Choi Min-hwan and Yul-hee began an open relationship in 2017 and married in 2018. They have one son and two daughters but divorced in December last year.
