Korea Music Contents Association Urges Action Amid NewJeans Tampering Allegation



Group NewJeans is on the verge of disappearing from the music charts.

We have already witnessed the so-called 'Tamping' attempts by an outside producer hired by an entertainment agency (hereinafter referred to as the 'Executive Agency') to cajole young and promising artists and parents to break up exclusive contractual relationships with existing agencies. Not long after the Fifteen Times incident, the recent allegations of tampering by Min Hee-jin, former CEO of Ador (hereinafter referred to as `Former CEO Min'), which were reported by certain media outlets, are very worrisome in that it has revealed how prevalent tampering is in the pop music industry, regardless of its authenticity. It also demonstrates the possibility that such attempts at tamping could take place not only in small- and medium-sized agencies but also in large agencies, leaving the association with this issue no longer to be seen.

If this series of events is repeated, no agency will be able to recruit great producers as part of the agency or give them autonomy in the form of outsourced services to engage with artists. In addition, if an internal/external producer uses intimate relationships with artists and parents to become independent of agencies and investment companies at any time regardless of contract, and uses their works and trade secrets recklessly, which agency will discover artists and make records, and which investor will invest in such agencies?

The members of the PFT withdrawal, which has sparked public outrage, have signed exclusive contracts with other agencies and are seeking activities. Now, more than ever, it is time for a clear answer from former representative Min, a direct party to this tamping case. There were numerous speculative articles that were not based on facts due to the exhausting media war encouraged by former representative Min. This has led to negative perceptions of the industry even by the public who were not interested in'Tamping' or K-pop. In addition, the tapering incident, which has been going on for the past eight months, has caused too much fatigue in the pop music industry. People in the pop music industry don't want to know about the incident through media reports anymore. Min should not avoid it with inflammatory and ambiguous answers, but should clarify the exact facts to end the current controversy.

Second, Singer NewJeans guarantees the faithful implementation of the exclusive contract and consults with the agency through sincere dialogue, but if an agreement is not reached, he must humbly wait for the judiciary's judgment. NewJeans is not the only one in the pop music industry. Many senior artists, executives and employees of other agencies, colleagues and junior artists who are developing their dreams by seeing NewJeans are doing their best in their respective positions. Even if there is room for this case to be regulated as a violation of the director's duty to be faithful or an act of breach of trust under the current law, the laws and systems that conform to the specificity of the pop music industry are currently insufficient. Organizers discover artists through large investments over a long period of time and produce numerous tangible and intangible creations in the process. Therefore, we ask for the maintenance of order in the popular music industry and the introduction of individual laws or systems to establish sound correlation.

Fourth, the Circle Chart operated by the association will consider excluding album and music sales from agencies and related artists suspected of tampering from the aggregate. What they have in common is that major domestic agencies exploit the fact that they are listed companies to promote public opinion with inflammatory claims without fact-checking. The act of damaging the image by mass-producing issues that need to be dealt with according to due process in the court as gossip in the entire pop music industry is spreading like a trend.
