On the 21st, the prosecution demanded a three-year prison term and a three-year restriction on employment in an appeal trial against A, who was indicted on charges of violating the Special Act on the Punishment of Child Abuse Crimes and the Welfare of Disabled Persons Act.
The prosecution has denied and has not reflected on the crime even though the defendant, who is obligated to report a child abuse crime, is emotionally abusing the child and has an extremely poor nature of crime. We did not make any efforts to recover from the damage and were not forgiven by the affected children.
In addition, the judgment of the first trial that did not acknowledge the intentionality of abuse was wrong. Children with autistic disabilities have low hearing thresholds and are sensitive to sound stimuli, but the behavior of speaking in a loud voice that is irritating in the face acts as a stress factor. There is an intention of abuse, albeit incompletely."
Joo Ho-min's lawyer said, `Children who have been abused cannot forget their heartache when they are emotionally abused rather than physically abused. It's a pity that we can't hear the hearts of the victims."
Mr. A's lawyer believes that the original judgment, which recognized the recordings secretly recorded by Joo Ho-min's parents as evidence, was wrong.
In his final statement, Mr. A said, `One day, suddenly, a terrible and incredible word of shock, the accused of child abuse, pointed at me and pointed a finger. Looking back on the 20 years of teaching, I think it was not perfect every moment, but it was not a shameful teacher. I'm not a child abuser, even if I think about it 10 million times."
In 2023, Joo Ho-min filed a complaint against A on charges of child abuse, saying he abused his son B, who had autism.
In September 2022, while taking classes in a regular class, B took off his pants and made unexpected actions, such as exposing himself in front of a female student. The victim, who was shocked by this, complained of mental pain, and B took classes in a special class. Joo Ho-min and his wife secretly recorded A by sending a micro recorder in B's coat on the grounds that B showed abnormal behavior such as refusing to go to school after moving to a special class. After that, Mr. A said "You have a bad habit"Oh, I don't like it. I hate it. He filed a complaint saying he had secured circumstantial evidence that he emotionally abused Mr. B with remarks such as "I don't like you."
The first trial court found the recordings of undisclosed conversations between others as evidence of illegal collection, but recognized the evidence ability in consideration of exceptions to the case, such as the fact that the child is autistic, and found him guilty of emotional abuse. Finally, in the first trial, A was sentenced to a fine of 2 million won.
The second trial will be held on February 18.
However, netizens' responses were mixed. Some people side with Joo Ho-min and his wife, saying, "'How can you respond to a child in that way, even though you are a special teacher?' If it's not abuse to say no to you in front of your face, what is wrong with the victim?', 'The profession of a special teacher will disappear', and 'I didn't know you were going to jail because you were on a recording all day long.'
