A sentencing trial was held for A, who was indicted on charges of violating the Special Act on the Punishment of Sexual Violence Crimes, etc., at the hearing of the 11th Criminal Division of the Gwangju District Court (Chief Judge Ko Sang-young) on the 17th.
On this day, the court ordered A to serve three years in prison, complete 40 hours of sexual violence treatment programs, and restrict employment at institutions related to children and adolescents with disabilities for five years.
Mr. A is accused of committing sexual crimes against two theater actors in Gwangju from 2012 to 2013, and in 2016.
The victim held an open press conference in June 2022 and revealed that `when the play began, he was sexually assaulted by a theater company official during the first company dinner and preparation for the play.'
As a result, an investigation into Mr. A has begun. Mr. A pleaded not guilty, saying, `There was no forced harassment against the will,' but was legally punished three years after the outbreak of 'Me Too'.
The court said "The victim's testimony is consistent in the important part, and the statements about the details of the resistance and the words and actions before and after the crime seem credible. Although it has been quite a long time, the complaint does not seem unnatural or unreasonable. As a senior in the theater industry, A is quite guilty of harassing or committing sexual crimes using his superior position.
However, some of the crimes themselves were acknowledged, there was no history of punishment exceeding past fines, and a medical review of injuries suffered by victims in the sex crime process was needed as reasons for sentencing, and court arrest was avoided.
In this regard, the Gwangju Theater Company's Sexual Violence Case Resolution Countermeasures Committee said, "This ruling is a significant ruling that recognizes the causal relationship with the mental and physical trauma of victims of sexual violence and was sentenced to severe imprisonment even after the statute of limitations. The acquittal does not deny the facts of the case, but is a court judgment that considers the possibility of contention and the defendant's right to defend. Victims and countermeasures committees will be held seriously responsible until the end."
