Kang (55), a doctor who killed the late Shin Hae-chul by medical negligence, was sentenced to prison and arrested in court on another medical accident.

According to the legal community on the 12th, the Criminal Appeals Department 9 (Chief Judge Lee Seong-bok) of the Seoul Central District Court sentenced Kang, who was charged with professional negligence on the 11th, to one year in prison and arrested him in court as in the first trial.

Earlier, Kang appealed on the grounds that the sentence was heavy, but the second trial court dismissed it, saying, "Although the defendant deposited 30 million won from the lower court, severe punishment is inevitable due to irreversible damage such as death."




He also explained that "the degree of negligence in the work was not light, and the victim was unable to move for a considerable period of time, which led to his death."" The defendant attributes the victim's death to the victim, and the bereaved family is also pleading for severe punishment.'

Kang was indicted without detention in November 2021 on charges of causing the patient to die by professional negligence, such as tearing a blood vessel during a deep vein thrombus removal surgery of a male patient in his 60s in July 2014. At that time, the patient suffered a large amount of bleeding during the operation and was immediately transferred to another hospital, but died in 2016.

Kang argued that the causal relationship between medical negligence and the patient's death is not established because the patient died more than 20 months after undergoing surgery, but the court refused to accept it.




Meanwhile, Kang was put on trial in 2014 on charges of causing a medical accident and causing a hole in singer Shin Hae-cheol's stomach, such as performing a surgery to remove the adhesion of the gastrointestinal tract.

As a result, Kang was indicted for professional negligence resulting in death, and his medical license was revoked after he was sentenced to one year in prison in May 2018. However, under the current medical law, even if the doctor's license is revoked, it can be reissued if the person applies again after up to three years.
