Seo Young-seok, a member of the Democratic Party of Korea (Bucheon-si-gap, Gyeonggi-do, National Assembly Health and Welfare Committee) proposed on the 28th a partial amendment to the law on hospice, palliative care, and life-sustaining care decisions for patients on their deathbed (hereinafter referred to as amendments).

The revision calls for the establishment of a basis for a professional public ethics committee and the lifting of the designation of the public ethics committee in connection with the decision and implementation of life-sustaining treatment, the establishment of an educational order for the negligence of record preservation, and the imposition of fines.

The current law requires medical institutions to establish a medical institution ethics committee to perform tasks related to the decision to suspend life-sustaining treatment, etc.



At the same time, it stipulates that a public ethics committee can be designated so that medical institutions can entrust the performance of the work performed by the medical institution ethics committee.

However, the purpose of the amendment is to establish a new legal basis for the lifting of the designation of the public ethics committee because the current law only stipulates that the public ethics committee can be designated, and only stipulates matters necessary for composition and operation.



In addition, the amendment includes strengthening support for medical institutions that wish to participate in the life-sustaining medical decision-making system by allowing a professional public ethics committee to be designated among public ethics committees to revitalize the public ethics committee.

In addition, the current law imposes penalties and suspension of qualifications only for false preparation and preservation of records related to the decision to suspend life-sustaining treatment and its implementation, and there is no provision for negligence in the process of preparing and preserving records.



Accordingly, the amendment calls for establishing a new basis for issuing an education order to medical personnel of the medical institution when negligence occurs in the process of preparing and preserving records, and imposing fines if they do not follow the education order.
