A married couple in China filed for divorce.

According to Chinese media such as Jimu News and China Dotcom, a court in Panjihua, Sichuan Province, announced a case in which a close relative filed for divorce after marriage.

The court ruled on the 23rd that the divorce lawsuit filed by his wife, identified only by her surname Yang, against her husband, Luo, was invalid.



Yang's father and Luo's mother are siblings, and Yang and Luo are cousins.

In accordance with village customs in 2013, the two married and lived together, and after registering their marriage in 2017, they gave birth to a daughter in 2019.



However, Yang filed a divorce suit with the court in October 2023, saying that his marriage to Luo had collapsed.

The court judged that their marriage was invalid from the beginning according to the law, saying "The relationship between the couple is a kinship that prohibits marriage under civil law."



Since the marriage itself was invalid, divorce itself was not established.

According to the court, the two therefore do not have the rights and obligations of a husband and wife. However, he said that parents' obligations to their children exist between the two, and that they should fulfill their responsibilities. The two are said to have agreed and adjusted on child support, joint property division, and debt contributions.
