Audor does not apply for a provisional injunction prohibiting the conclusion of an advertising contract with Newzins (Full Story)

Audor filed an injunction against the members of New Jeans, including preserving the status of an agency and signing an advertising contract.

Audor said on the 13th that `Last week, we filed a injunction against the members of Newzins in the Seoul Central District Court against the prohibition of preserving the status of an agency and signing an advertising contract.'

In December last year, Odor filed a lawsuit with the Seoul Central District Court to confirm the validity of the exclusive contract. However, since it may take a considerable amount of time to make a final ruling, it applied for a provisional injunction to prevent the current confusion.

"To prevent Theodore from being recognized as an agency under the exclusive contract and from advertising contracts and activities independently by the members of the Newzins," Adore said. "Newzins members who unilaterally declared the termination of the exclusive contract continue to attempt to sign the contract by contacting advertisers independently. The request for such provisional injunction was made to prevent confusion and damage to third parties such as advertisers.

"This provisional injunction application reflects Adore's intention to be with the members of the New Jeans," Adore said. According to its position that its exclusive contract with Newzins is valid, Ador has continued to support all personnel and equipment for Newzins' entertainment activities, and plans to continue to do so.'"Ador said, adding, "We are receiving proposals from outside for various projects such as advertising and events, and internally, we want to fully communicate with the members by planning and completing our activities including the release of our regular album and fan meeting."

Last week, Audor filed a injunction against Newzins members in the Central District Court in Seoul against 'Prohibiting the Preservation of the Company's Status and the Conclusion of Advertising Contracts'

The injunction is aimed at preventing members of Newzins from engaging in advertising contracts and advertising activities independently without the approval or consent of Ador until the first trial ruling of the 「Exclusive Contract Validation Procedure」 filed with the Seoul Central District Court on December 3 last year.

Adore's application for the provisional injunction is aimed at preventing confusion and damage to third parties, including advertisers, as Newzins members who unilaterally declared the termination of their exclusive contracts continue to attempt to sign contracts by contacting advertisers independently.

The fact that the members' unilateral claim to terminate the exclusive contract is unfair will be confirmed through the exclusive contract validation office filed by Adore. However, since it could take a considerable amount of time for a final ruling, we were forced to apply for an additional provisional injunction to urgently prevent the current confusion.

This provisional injunction application reflects Audor's intention to be with the members of the New Jeans. If the market and industry continue to be confused by the members' independent actions, the brand value of Adore's only artist, Newzins, will inevitably fall, and as a result, Adore will lose competitiveness as an agency and face a management crisis. It also reflected the judgment that even if the original ruling was made that the exclusive contract was valid years later, it might not be possible to restore it to its original state.

In a provisional injunction application, Odor appealed to the court that there must be an opportunity to correct misjudgment or conduct before legal liability can be expanded out of control even for Newzynes. He also expressed concerns across the industry that `if the company unilaterally declares the termination of exclusive contracts and sets a precedent for independent entertainment activities without legal procedures, investment incentives in the entertainment industry will disappear and the foundation of the K-pop industry will be shaken and greatly contracted.'

Meanwhile, Audor has consistently supported all personnel and facilities for Newzins' entertainment activities in line with the position that the exclusive contract with Newzins is valid, and plans to continue to do so. Additionally, Adore has been offered a number of projects from outside, including advertising and events, and internally, he has already planned and completed this year's activities, including the release of a regular album and a fan meeting, so that he can fully communicate with the members of Newzins.
