It was concluded that the chairman-appointed members of the Sports and Fair Commission judged that the process of deliberating on the extension of his term was unconventional and that the criteria for allowing consecutive terms were also in violation of the articles of association of the Korea Sports Commission.
The term of office of executives of the Korean Sports Council and member organizations shall be consecutively renewed only once, but the term of office shall be extended after deliberation by the Korean Sports Council's Sports Fair Committee. On February 28, 2023, Lee Ki-heung, chairman of the Korea Sports Council, was delegated the authority to appoint members at the regular general meeting of the National Assembly for the composition of the current Sports Fair Committee. The Ministry of Culture, Sports and Tourism accepted Chairman Lee's opinion as it was at the time, considering the autonomy of the Korean Sports Council and the review of members' organizations.
However, the Ministry of Culture, Sports and Tourism stated that if the head of the Korean Sports and Tourism applies for deliberation with the Sports and Fair Commission to extend his term of office, it will occur that the member appointed by him/her will be deliberated on the permission to allow him/her to limit his/her consecutive terms", and took issue with the procedure of 'self-deliberation". Then, the Ministry of Culture, Sports and Fair Trade Commission believes that the criteria for deliberation on extending the term of office are also in violation of the articles of association. The articles of association of the Korea Sports Association (Article 29 (1)) stipulate that exceptions to the two-term limit can be recognized only when the contribution is clear as a result of quantifying and evaluating indicators such as financial contributions, major international competition performance, and group evaluation.
The articles of association stipulated quantitative evaluation that quantified indicators, but in reality, the proportion of qualitative evaluation reached 50%, and 70% of the screening indicators were unrelated or very relevant to the articles of association. In addition, the Ministry of Culture, Sports and Tourism recommended to the Korea Sports Association and the Korea Sports Association for the Disabled on the 3rd that the disciplinary jurisdiction of the executives of sports organizations be raised. Following the recommendation of the Anti-Corruption and Civil Rights Commission in February, the Korea Sports Council and the Korea Sports Association for the Disabled should have jurisdiction over disciplinary action against executives of affiliated member organizations (including membership organizations of the Korea Sports Council and membership organizations of the Korea Sports Association for the Disabled). It is judged that it is not fair for the organization to directly deliberate on the disciplinary action of the sports organization executives (including the chairman).
Although the two organizations expressed their difficulty accepting disciplinary jurisdiction because it is their own authority, the Ministry of Culture, Sports and Tourism demanded that the two organizations implement the recommendation of the Anti-Corruption and Civil Rights Commission to improve the system for the following three reasons. ①The Korea Sports Association and the Korea Sports Association for the Disabled exercise a wide range of leadership and supervision powers, including the designation of management organizations (dismissal of executives, suspension of qualifications, direct management, etc.), the chairman's approval (approval), and comprehensive directives, and it is contradictory that they will respect the executive's disciplinary jurisdiction only while directly disciplining the chairman's election or national competition-related irregularities, and 38 38 (33%) of 116 cases that have not been implemented since the launch of the Sports Ethics Center in August 2020 despite requesting disciplinary action until April 2024, and ③ In some, There is an abnormal situation in which the disciplinary suspect concurrently serves as the chairman of the legal punishment committee (presiding judge) of the organization concerned and does not deal with disciplinary action.
The Ministry of Culture, Sports and Tourism has asked both organizations to submit whether to implement the two recommendations by the end of September, and will review follow-up measures depending on whether to accept them.
