Chairman Lee was notified of his suspension from the Ministry of Culture, Sports and Tourism immediately after the announcement of the results of the investigation by the government's joint public service inspection team in the Cabinet Office on the 11th of last month.
The Ministry of Culture, Sports and Tourism notified Lee Ki-heung, chairman of the Korea Sports Council, of suspension of his duties under Article 52-3 of the Act on the Operation of Public Institutions on the 11th (request for investigation of illegal employment of employees, demand for sponsorship (receiving money and goods, etc.), and immediately filed a lawsuit and suspension of execution with the Seoul Administrative Court on the 12th, the following day. The application for suspension of execution of an administrative lawsuit is a concept similar to the application for provisional disposition in a civil lawsuit. However, the Seoul Administrative Court rejected Chairman Lee's request for suspension of his duties against the Ministry of Culture, Sports and Tourism.
After the closing arguments on the 3rd, the decision to dismiss was made on the 12th. The Seoul Administrative Court rejected the application for suspension of execution because it was deemed significantly more likely to have a significant impact on public welfare by suspending the effectiveness of the disposition, even if it is difficult to admit that the disposition of this case may cause irreparable damage to the applicant or there is an urgent need to prevent it. In addition to the details, nature, and duration of the misconduct indicated as the basis for the disposition of this case, the matters pointed out as misconduct by the applicant cannot be concluded to be false and worthless, even if the authenticity is not clearly obscured.
The suspension of duties will remain until the result of the main issue of the administrative lawsuit is released. Attention is focusing on whether the Ministry of Culture, Sports and Tourism will approve the suspension until February 27, the 41st presidential term, and if Chairman Lee succeeds in serving his third consecutive term as the 42nd chairman. Lee, who received approval from the Korea Sports and Fair Trade Commission for a third consecutive term, will soon officially announce his intention to run for office.
